This website www.thesoleilgirl.com (hereinafter the “Site”) is owned and operated by The Soleil Girl (hereinafter "The Soleil Girl"), a business incorporated in Singapore.
By accessing and using any part of this Site, you unconditionally agree and accept to be legally bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use this Site.
In case of any violation of these Terms and Conditions, The Soleil Girl reserves the right to seek all remedies available under the law and in equity for such violations. These Terms and Conditions apply to all visits to this Site, both now and in the future.
The Soleil Girl reserves the right to change these Terms and Conditions from time to time at its sole discretion. All changes will be posted on this page, and your use of this Site after such changes have been posted will constitute your agreement to the modified Terms and Conditions and all of the changes. Where you create a user account and password, you must treat such information as confidential, and you must not disclose it to any third party. We reserve the right to disable any user account at any time, if in our opinion you have failed to comply with any of the provisions of these Terms and Conditions.
You agree and undertake not to use the Site for illegal purpose, transmit or distribute a virus, spyware and/or malware including but not limited to Trojan horse, worm, logic bomb, or post any other material on the Site, or its related social media and/or communication platforms, which is malicious, technologically harmful, in breach of confidence, or in any way offensive or obscene; hack into any aspect of the Site; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material; or attempt to affect the performance or functionality of any computer facilities of, or accessed throughout this Site.

The Soleil Girl is the owner or the licensee of all intellectual property rights in and to the contents on the Site, and in the materials published on it. Except as otherwise provided in these Terms and Conditions, contents of this Site shall not be reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way, without the prior written permission of The Soleil Girl.
You may use, hyperlink, copy and distribute the contents found on this Site solely for personal, internal, non-commercial and informational purposes only. You may not display, distribute or otherwise use any of the content found on this Site for any commercial purpose without prior written consent from The Soleil Girl.

This Site may contain links to third party websites that are not affiliated with or owned, operated, or controlled by The Soleil Girl, including third party payment system providers. The Soleil Girl shall not be responsible for the content of any hyperlinked website, or liable for any loss and damages from your access to those websites.
All hyperlinks to other websites are provided as a convenience to you as a user of this website. We encourage you to review the terms and conditions and privacy policies of any third party websites before using them and disclosing your personal data to them.
PURCHASE ORDERS
By placing an order with us, you are (i) offering to purchase a product, and (ii) representing that all information you provide to us in connection with such order is true and accurate and you are an authorized user of the payment method provided.
The receipt by you of an order confirmation does not constitute our acceptance of an order. We retain the right to refuse any request made by you. Prior to our acceptance of an order, verification of information may be required. We reserve the right at any time after receipt of your order to accept or decline your order, or any portion thereof, even after your receipt of an order confirmation from us, for any reason whatsoever.
All unfulfilled orders regardless of reason will automatically be cancelled and a full refund will be completed within 5 working days from the day we acknowledge your mode of refund. In certain cases we may only offer store credits as a refund.
The refund will be credited into the account from which the order was paid for (i.e. If you paid via any third party gateways like Paypal, refund will be credited via PayPal). Please provide us with the account details (email address entered on PayPal when making payment) upon receiving our Order Cancellation email.
All Promotional Codes have to be entered upon purchase to be valid. Discount can't be applied on an order retrospectively (i.e. after it has been successfully made).
We reserve the right to limit the number of items ordered and to refuse service to you without prior notification.
Price
All prices displayed on our Site are quoted in Singapore dollars (SGD). All prices displayed on our Site are subject to change and we reserve the right to make changes to all prices without prior notice and without incurring any obligations to you. If you are a customer whose credit/debit card is not denominated in SGD dollars, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.
In the event whereby a merchandise displays an incorrect price, either due to typographical or other error, we shall have the right to refuse or cancel any such order placed for the incorrect price, regardless of whether the order is being or has been processed. If payment has already been made or if your account has already been charged for the purchase and the order is cancelled, we shall credit your account in the amount of the incorrect price or cancel your order whichever is necessary.
Product Representation
Colour
We will always strive to display the colours as accurately as possible. However, as the actual colours you see depend on the resolution and/or settings of your monitor screen, the colours of the products visualized on the website could appear to be slightly different from the original. Such situations are out of our control and we cannot be held responsible for purchases made due to a different perception of colours.
Measurements
All measurements provided on our website are taken as accurately as possible. Despite our efforts, discrepancies may still be present due to the hand made process. Such instances are also not within our control, and we cannot be held responsible for those discrepancies unless it is beyond the grace limit. Product Content and Size Guide
Product description and sizing serve merely as a guideline. We cannot be held liable for minor description errors and varying interpretations on users' end. Photographs on the products should be referred to thoroughly. Responsibility will be borne by us should the photos look vastly different from product received, and constitutes a misrepresentation.
General Outlook
Products with minor imperfections that do not affect the outlook and function of the products, that may occur in the manufacturing of garments, are not deemed as faulty. This includes, but is not limited to, loose thread ends; slight asymmetry; slight misalignment; slight stains; slight scratches.
WARRANTIES AND LIABILITIES
The Site, its services and all information provided herein are provided on an “as is” basis without warranties of any kind.
Without limiting the generality of the foregoing, we expressly disclaim any warranty, condition, guarantee, term or representation (i) as to the reliability, accuracy, completeness, and validity of any content or material on the Site; (ii) that the functions contained on the Site will be secure, uninterrupted or error-free; and (iii) that any defects will be corrected. Any and all such warranties, conditions, terms and representations are specifically excluded. We assume no responsibility for errors or omissions in the materials on the Site, including factual or other inaccuracies or typographical errors. You expressly agree that your use and/or access of the Site is at your sole risk.
Without prejudice to the generality of the foregoing, we expressly disclaim any and all liability arising from:
- life or wear of any Product or that it will be suitable for any particular purpose or use under any specific conditions, notwithstanding that such purpose or conditions may be known or made known to The Soleil Girl;
- improper remedy of defective products, alteration of the products, unsuitable or improper use, wilful damage, negligence, or other misuse of the products, as well as fair wear and tear, by you or any third party;
- third party claims, whether directly or indirectly caused by, or relating to, the content of our Site and the products purchased on or through our Site; and
- any warranties provided under these Terms and Conditions if the total price for the Product has not been paid in cleared funds by the due date for payment.
You further acknowledge and agree that your access and use of the Site is dependent on third party service providers such as internet, network, connectivity or other link providers. Your payment for any Product purchased from the Site is processed by third party payment system providers and The Soleil Girl does not retain or process any such payment information. The Soleil Girl cannot guarantee the security of such third party payment system(s) or any payment data on the Site. The Soleil Girl is not responsible for any acts or omissions of any third parties and disclaims any and all liability in connection with the acts, omissions or defaults of such third parties. Without prejudice to the generality of the foregoing, The Soleil Girl is not responsible for the results of any credit inquiry, the availability or performance of the Internet, your connection to the Internet or the actions or inaction of any other person or entity, including any internet service provider. By using the Site, you expressly relieve The Soleil Girl from any and all liability in connection with the acts, omissions or defaults of such third parties.
INDEMNITY
You hereby agree to indemnify and hold The Soleil Girl and our partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives harmless from and against any and all claims, losses, liabilities, costs and expenses arising directly or indirectly out of your access to or use of this Site including:
i) any claims of infringement of a third party’s rights;
(ii) damage to tangible property, bodily injury, or death;
(iii) negligence or wilful misconduct caused or attributable to you or any of your agents, and
(iv) breaches of your obligations under these Terms and Conditions.
TERMINATION
We will determine in our sole discretion whether there has been a breach of these Terms and Conditions through your use and/or access of the Site. When a breach of these Terms and Conditions have occurred, we may take such action as we deem appropriate, including:-
- Immediate, temporary or permanent withdrawal of your right to use and/or access the Site;
- Issuing a warning to you;
- Commencing legal proceedings against you for loss resulting from your breach; and
- Disclosure to law enforcement authorities of such information as we reasonably deem necessary.
We exclude liability for any actions taken in response to breaches of these T&Cs. The responses described above are not exhaustive, and we may take any other action we reasonably deem appropriate.

These Terms and Conditions shall be governed and construed in accordance with laws of Singapore.
